ELEVATOR SAFETY BOARD
Meeting Minutes March 20, 2018
I.    Call to order

Chairperson Kris Kesterson called the meeting to order at 9:00 a.m. in the conference room at 150 Des Moines Street, Des Moines, Iowa.

II.    Roll call

Members present:    Kris Kesterson, Peggy VandenBerg (via phone), Wayne Sims, Justin Carleton, Kerry Dixon and Kathleen Uehling

Members absent: Amy lnfelt and Todd Christensen

Ms. Emily Willits, Director, Licensing & Administrative Law Division, also attended.

Ill.    Approval of agenda

Ms. Dixon moved to approve the agenda and Mr. Sims seconded the motion. The Board approved it unanimously.

IV.    Approval of minutes from November 15, 2017

Mr. Schumacher moved to approve the November 15, 2017 minutes. Ms. Dixon seconded the motion and the board approved it unanimously.

V.    Item for Action

         A.    Adoption of rules noticed in the December 20, 2017 Iowa Administrative Bulletin as 3503C

Ms. Uehling reviewed the adopted and filed rule changes from the Notice of Intended Action. Ms. Dixon moved to approve the adoption. Ms. Uehling seconded and the motion was approved unanimously.

         B.  Notice of Intended Action concerning rules review and Labor Commissioner's recommendations

Ms. Uehling reviewed the proposed Notice of Intended Action with the board.

Mr. Sims noted that Item 12 "h" should read as "when not being serviced" rather than "not in use." Ms. Uehling noted the proposed change.

Mr. Carleton received a draft document from National Elevator Industry, Inc., (NEIi) . Although NEIi requested that the draft document not be distributed, Mr. Carlton read parts of the document stating objections to some of the rule proposals. If NEIi elects to comment during the public comment period, the board will be able to consider those comments.
 
Ms. Dixon moved to proceed with the Notice of Intended Action. Mr. Schumacher seconded and the board approved it unanimously.

Ms. VandenBerg left the meeting.

VI.    Division of Labor Report

Labor Commissioner Mauro thanked the board for their support for the classification change and upgrade for state elevator inspectors.

There are currently three inspector openings posted. Des Moines, Iowa City and Cedar Rapids are the targeted territories.

Vll.    Communications

Variance requests from the City of Le Mars and Acadian Ingersoll were withdrawn prior to the meeting.

VIII.    Next meeting dates

•    Tuesday, April 24, 2018 at 9:00 a.m., 150 Des Moines Street
•    Wednesday, May 30, 2018 at 9:00 a.m., 150 Des Moines Street

IX.    Next meeting agenda

•    Tabled variance from Ed Allen and Lexington Apartments (E2017-182)
•    Discussion of process to follow when a conveyance doesn't pass a safety test

X.    Public comments

XI.    Adjournment

Mr. Sims moved to adjourn the meeting. The board approved. The meeting adjourned at 10:00 a.m.
